Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Lodging TX Analytics(the “Service”). By creating an account or using the Service, you agree to these Terms.
1. The Service
Lodging TX Analytics provides analytics derived from Texas hotel-occupancy-tax filings and other public records. The Service presents revenue and performance figures as reported to the Texas Comptroller of Public Accounts. We are an independent product and are not affiliated with, endorsed by, or sponsored by the Comptroller or any government agency.
2. Accounts
You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and able to form a binding contract.
3. Subscriptions & billing
Access requires a paid subscription billed on a recurring basis. Fees are charged in advance and are non-refundable except where required by law. You may cancel at any time; your access continues through the end of the current billing period. We may change pricing with reasonable notice, effective at your next renewal.
4. Acceptable use
You agree not to: (a) resell, redistribute, or create a competing dataset from the Service; (b) scrape, bulk-export, or use automated means to extract data beyond normal use; (c) share your account with others; or (d) use the Service unlawfully or to infringe others’ rights.
5. Data accuracy — no warranty
Figures are shown as reported to the stateand may contain data-entry errors, omissions, or delays present in the source records. The Service is provided “as is” without warranties of any kind. Nothing in the Service is financial, investment, tax, or legal advice, and it must not be relied upon as the sole basis for any transaction. You are responsible for independently verifying figures before acting on them.
6. Intellectual property
The Service, including its software, design, and compiled analytics, is owned by Lodging TX Analyticsand protected by law. Underlying public records are not owned by us. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes.
7. Termination
We may suspend or terminate access for violation of these Terms. You may stop using the Service and cancel at any time.
8. Limitation of liability
To the maximum extent permitted by law, Lodging TX Analytics will not be liable for any indirect, incidental, or consequential damages, or for any lost profits or business, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid in the twelve months before the claim.
9. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
